Welcome to Eloise Sri Lanka (“Eloise”, “we”, “us”, or “our”). Eloise is a homeware and décor store operating in Sri Lanka. These Terms of Service (“Terms”) govern your access to and purchase of products from our website, mobile app, physical stores (if any), and related services. By accessing or using Eloise, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a contract under Sri Lankan law.
If you are under 18, you may use Eloise only with the involvement of a parent or guardian who agrees to these Terms on your behalf.
If you use Eloise on behalf of a business or organization, you represent and warrant that you have authority to bind that organization.


3. Accounts and Registration
Some features require creating an account. You must provide accurate, current, and complete information.
Keep your account credentials secure and notify us immediately of any unauthorized use. You are responsible for all activity on your account.


4. How Orders Work (Purchase Terms)
Orders are subject to acceptance and availability. After you place an order you will receive an order confirmation email. This confirmation does not mean the order has been accepted; acceptance occurs when we dispatch the product or expressly confirm acceptance.
All prices are quoted in Sri Lankan Rupees (LKR) unless stated otherwise. Prices shown do not always include delivery charges or applicable taxes — these will be shown at checkout.
Payment must be received before dispatch. We accept the payment methods displayed at checkout (e.g., credit/debit cards, bank transfer, mobile payment). We may use third‑party payment processors — your use of those services is subject to their terms.


5. Taxes, Duties & Fees
Applicable taxes (including VAT) will be displayed at checkout or invoiced separately as required by Sri Lankan law.
For international orders (if offered), customers are responsible for customs, duties, and import taxes.


6. Delivery & Shipping
Delivery times are estimates only and may vary. We are not liable for delays caused by third‑party carriers, customs, or force majeure events.
Domestic delivery: we deliver across Sri Lanka. For remote locations there may be additional charges.
International delivery: available only where expressly offered; additional shipping costs, customs duties and import taxes may apply.


7. Cancellations, Returns & Exchanges
Cancellation: You may cancel an order before it is dispatched. Once dispatched, cancellation may not be possible. Contact customer support immediately to enquire.
Returns & Exchanges: We accept returns/exchanges in accordance with our Returns Policy. Typical policy (customize as needed):
Items in original, unused condition with tags intact may be returned within 14 days of delivery for a refund or exchange, except for bespoke/custom-made items, sale/clearance items, and hygienic items which may be non-returnable.
You are responsible for returning the goods in a secure condition. Return shipping costs may apply unless the return is due to our error or a defective product.
Refunds: Refunds will be processed to the original payment method within a reasonable time after we receive and inspect the returned item, subject to these Terms.

8. Product Descriptions, Availability & Pricing
We aim to describe products accurately, but colors, textures, and sizes may vary slightly from images. Product measurements are approximate.
If a product is unavailable after you place an order, we will notify you and offer a refund or an alternative product.
Errors in pricing or descriptions are subject to correction. If a pricing error is material, we may cancel the order and notify you.


9. Warranties & Defects
Manufacturer warranties: Where products include manufacturer warranties, the warranty terms apply and we will assist with claims where possible.
Defects & damaged goods: If you receive a defective or damaged item, notify us immediately with photos and order details. We will assess and provide repair, replacement, or refund in accordance with our Returns Policy and applicable Sri Lankan consumer protection laws.
Except as expressly stated, products are provided as-is and we disclaim implied warranties to the fullest extent permitted by law.


10. User Content & Reviews
If you submit reviews, images, or other content, you represent that you have the right to submit it and grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and promote that content in connection with Eloise.
You may not post content that is unlawful, infringing, defamatory, or abusive. We may remove content that violates these Terms.


11. Intellectual Property
All content on the Eloise site (text, images, logos, designs, product photos, and site design) is owned or licensed by Eloise. You may not use our trademarks or copyrighted material without our written permission.
Purchasing a product does not transfer any intellectual property rights in logos, images, or design files used by Eloise.


12. Privacy & Personal Data
Our use of personal data is described in our Privacy Policy. By using Eloise you agree to our collection and use of your data as described there.
We will comply with applicable Sri Lankan data protection requirements and apply reasonable security measures to protect personal information.

13. Limitation of Liability
To the maximum extent permitted by law, Eloise and its officers, employees and agents are not liable for indirect, incidental, consequential, punitive, or special damages arising from your use of the Service or products.
Our aggregate liability for claims arising out of or related to these Terms will not exceed the amount you actually paid for the relevant product(s) in the 12 months preceding the claim (or LKR [insert amount], whichever is greater). Some jurisdictions do not allow certain limitations; where prohibited by law, this limitation may not apply.
14. Indemnification


You agree to indemnify and hold Eloise and its representatives harmless from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of our products or services.
15. Force Majeure


We are not responsible for failure to perform due to causes beyond our reasonable control (natural disasters, strikes, transport failures, government actions, pandemics, etc.). In such events, delivery times may be extended and we will inform affected customers.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of Sri Lanka.
Any dispute arising from or relating to these Terms or your use of Eloise shall be submitted to the exclusive jurisdiction of the courts of Colombo, Sri Lanka. (If you prefer arbitration or alternate dispute resolution, tell me and I’ll change this clause.)


17. Changes to These Terms
We may update these Terms from time to time. We will publish the updated Terms with a new “Last updated” date. Continued use of Eloise after changes constitutes acceptance of the updated Terms. We will use reasonable efforts to notify customers of material changes (e.g., by email).


18. Miscellaneous
Entire Agreement: These Terms (and policies referenced herein) constitute the entire agreement between you and Eloise regarding the subject matter.
Severability: If any provision is unenforceable, the remainder will remain in effect.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.
No Waiver: Failure to enforce any right is not a waiver of that right.
